Terms of Service

These Terms of Service ("Terms") govern your use of the FieldGovern platform, operated by FieldGovern ("we", "our", "us"). By accessing or using our services, you agree to be bound by these Terms. If you are using FieldGovern on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. The Service

FieldGovern provides a B2B software-as-a-service (SaaS) platform for offline-first field data collection, management, and analysis. The service is available via a web application hosted at app.fieldgovern.com and as a Progressive Web App (PWA) installable on mobile devices.

2. Accounts and Access

Your organization ("tenant") receives a dedicated isolated account on the platform. The designated Org Admin is responsible for:

4. Data Ownership

You retain full ownership of all data you collect and store on FieldGovern. We do not claim any rights to your form definitions, submission data, or media files. We process your data only as necessary to provide the service described in these Terms and our Privacy Policy.

5. Data Responsibility

As the data controller for information collected through your forms, your organization is responsible for:

6. Subscription and Payment

FieldGovern is offered on a monthly subscription basis. Pricing is as listed on the Pricing page. Subscriptions renew automatically unless cancelled. No refunds are issued for partial months. Prices may change with 30 days' notice to the registered org admin email.

Enterprise plans are governed by a separate Master Service Agreement (MSA). Contact sales@fieldgovern.com.

7. Service Availability

We aim for 99.5% monthly uptime excluding scheduled maintenance. The offline-first architecture of FieldGovern means that data collection continues even when our servers are unreachable — enumerators can collect and store data locally and sync when connectivity is restored. We do not provide SLA guarantees unless specified in an Enterprise MSA.

8. Intellectual Property

All software, design, branding, and documentation of FieldGovern remain the exclusive intellectual property of FieldGovern. These Terms do not transfer any intellectual property rights to you. You may not copy, modify, or distribute the FieldGovern platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FieldGovern shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of data, revenue, or research outcomes. Our total aggregate liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FieldGovern from any claims, losses, or expenses (including legal fees) arising from your misuse of the platform, violation of these Terms, or infringement of any third-party rights through your data collection activities.

11. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the platform will cease at the end of the current billing period. You may request a data export before termination. We will delete your data within 30 days of account closure upon written request.

We may terminate or suspend your account immediately for material breach of these Terms, illegal activity, or non-payment.

12. Modifications to Terms

We may update these Terms from time to time. We will notify registered org admins by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
