These Terms of Service ("Terms") govern your use of the FieldGovern platform, operated by Pavankumar Deshetty ("we", "our", "us") in strategic partnership with Dataworx (led by Manjunath YN, CEO). By accessing or using our services, you agree to be bound by these Terms.

If you are registering FieldGovern on behalf of an organization — an NGO, research institute, government department, or corporate entity — you represent and warrant that you have the legal authority to bind that organization to these Terms, and that you accept these Terms on behalf of the organization.

Plain-language summary: You own your data. We provide the platform, you use it lawfully, and either party can end the relationship with proper notice. We are not liable for data collection decisions made by your organization. These terms are governed by Indian law, jurisdiction in Bengaluru, Karnataka.

1. The Service

FieldGovern provides a B2B software-as-a-service (SaaS) platform for offline-first field data collection, monitoring & evaluation (M&E), and research data management. The service is accessible via:

FieldGovern is designed for India's research and development sector, including public health researchers, agricultural scientists, census teams, NGO field staff, and government program monitoring units. The platform's core capability is the ability to collect and store data completely offline, syncing to the central server when connectivity is restored.

The platform is developed by Pavankumar Deshetty (Research Associate & Data Analyst, Kalike — Tata Trusts, Bengaluru) with the strategic guidance and domain expertise of Manjunath YN (CEO, Dataworx, Bengaluru) who serves as strategic growth partner.

2. Account Registration and Tenant Access

Each organization receives a dedicated, isolated account ("tenant") on the FieldGovern platform. Within your tenant, access is structured by roles:

Your organization is responsible for all activity that occurs under your tenant account, including activity by all users you have onboarded. If you suspect unauthorized access, notify us immediately at hello@fieldgovern.com and revoke affected API keys from the platform settings.

You may use FieldGovern only for lawful field data collection, research, program monitoring, and related activities. You agree not to use FieldGovern to:

We reserve the right to suspend or permanently terminate accounts that violate these policies, without refund, and to report illegal activity to relevant law enforcement or regulatory authorities.

4. Data Ownership and Your Rights

You retain full, exclusive ownership of all data your organization creates, collects, and stores on FieldGovern. This includes:

FieldGovern claims no intellectual property rights over your data. We process your data solely as a service provider to deliver the platform functionality described in these Terms. You may export your data in CSV, JSON, or Excel format at any time. Upon account closure, you may request a complete data export before deletion.

5. Data Controller and Processor Responsibilities

In the context of your field research activities, your organization is the data controller — you determine the purposes and means of processing personal data collected through your forms. FieldGovern acts as the data processor — we process data on your behalf according to your instructions and these Terms.

6. Subscription and Payment Terms

FieldGovern is offered on a monthly subscription basis. Current pricing is listed on the Pricing page. By subscribing, you agree to the following payment terms:

Enterprise and government clients are governed by a separate Master Service Agreement (MSA) negotiated with Dataworx. Contact sales@fieldgovern.com or pallavi@dataworx.co.in for enterprise pricing.

7. Service Availability and Uptime

We aim to maintain 99.5% monthly uptime, measured excluding scheduled maintenance windows. Scheduled maintenance, when required, will be announced at least 24 hours in advance via the platform dashboard and email to registered Org Admins. We do not provide uptime SLA guarantees unless specified in a separate Enterprise MSA.

The offline-first architecture of FieldGovern means that field data collection continues uninterrupted even during server downtime or scheduled maintenance. Enumerators can collect and store data locally on their devices and sync when connectivity and server availability are restored. No data is lost due to server unavailability.

8. Intellectual Property

All software code, user interface design, branding, logos, documentation, and the FieldGovern platform as a whole are the exclusive intellectual property of Pavankumar Deshetty and FieldGovern. These Terms do not transfer any intellectual property rights to you. Your subscription grants you a limited, non-exclusive, non-transferable right to access and use the platform for its intended purpose during the subscription period.

You may not copy, reproduce, modify, distribute, sell, sublicense, or create derivative works based on the FieldGovern platform or any part thereof. The FieldGovern name, logo, and associated marks are proprietary and may not be used without written permission.

9. Confidentiality

Both parties acknowledge that during the course of using FieldGovern, each may have access to the other's confidential information. FieldGovern will treat your organization's data, form designs, and research content as confidential, in accordance with our Privacy Policy. You agree to treat any non-public information about FieldGovern's platform, pricing, or roadmap that you become aware of as confidential and not disclose it to third parties without our consent.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, FieldGovern (including its developer Pavankumar Deshetty and strategic partner Dataworx) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to:

Our total aggregate liability for any claim arising from or related to your use of FieldGovern is limited to the total subscription fees you paid to us in the three (3) calendar months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless FieldGovern, its developer (Pavankumar Deshetty), and its strategic partner (Dataworx and Manjunath YN) from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

Either party may terminate the subscription at any time:

Upon termination for any reason, you may request a complete data export within 30 days of termination. After 30 days, data will be permanently deleted from our systems. Dataworx or FieldGovern does not bear any liability for data loss resulting from expiry of this export window.

13. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, government actions, internet infrastructure failures, third-party cloud provider outages, or civil unrest. The affected party shall notify the other as soon as practicable and shall use commercially reasonable efforts to minimize the impact and resume performance.

14. Modifications to Terms

We may update these Terms from time to time as the platform evolves or as legal requirements change. For material changes affecting your rights or obligations, we will notify registered Org Admins by email at least 14 days before the changes take effect. The updated Terms will be posted on this page with a revised "Last updated" date.

Your continued use of FieldGovern after the effective date of any updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cease using the platform and may terminate your subscription under Section 12.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the FieldGovern platform shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.

Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve the dispute informally by contacting the other party in writing with a description of the dispute and the resolution sought. The parties will have 30 days to attempt informal resolution before either party may pursue formal legal action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and any separate Enterprise MSA or addenda executed between the parties, constitute the entire agreement between you and FieldGovern with respect to the platform and supersede all prior negotiations, representations, warranties, and understandings, whether written or oral.
